Welcome to janebasch.com (the "Site"), operated by Jane Basch Designs ("we," "us," or "our"). By accessing or using the Site, or by purchasing anything from us, you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

You must be at least 18 years of age, or the age of majority in your state or province of residence, to make a purchase on the Site. You agree not to use our products for any illegal or unauthorized purpose, and not to violate any laws in your jurisdiction while using the Site. You may not transmit any viruses or code of a destructive nature. A breach of any of these Terms will result in immediate termination of your right to use the Site.

2. Products, Pricing & Availability

All of our jewelry is handcrafted, and many pieces are made to order and personalized to your specifications. Slight variations in finish, texture, and appearance are inherent to handmade fine jewelry and are not defects.

Prices for our products are subject to change without notice, including in response to fluctuations in the market price of gold, silver, and other precious materials. We reserve the right to modify or discontinue any product at any time. Occasionally there may be information on the Site that contains typographical errors or inaccuracies relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to cancel orders if any information is inaccurate, including after an order has been submitted. If your order is cancelled after payment, you will receive a full refund.

3. Personalized & Custom Orders

You are responsible for verifying the accuracy of all personalization details you submit — including spelling, initials, dates, monogram letter order, chain length, ring size, and metal choice — before placing your order. Personalized items are made exactly as ordered. We cannot accept returns, exchanges, or offer refunds on personalized or custom pieces unless the item arrives damaged or we made an error in production. If you notice a mistake in your order, call us immediately at (800) 558-1144; once production has begun, changes may not be possible.

4. Payment

We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge your order total, including applicable taxes and shipping, to that payment method.

5. Shipping & Risk of Loss

Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you upon our delivery of the merchandise to the carrier, except where we have provided shipping insurance, in which case claims will be handled as described in our Shipping Policy.

6. Returns

To the fullest extent permitted by law, Jane Basch Designs shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Site or products purchased through it. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless Jane Basch Designs and its owners, employees, and affiliates from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Broward County, Florida.

We reserve the right to update, change, or replace any part of these Terms by posting updates to the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
